This is a brief summary of what the implications of the Act are, and has been prepared by officials at the DTI. It is not intended to be an official document to accompany the Act: the official Explanatory Notes to the Act are available from the OPSI website at  HYPERLINK "http://www.opsi.gov.uk/ACTS/en2006/2006en19.htm" http://www.opsi.gov.uk/ACTS/en2006/2006en19.htm. All sections of the Act relate to England and Wales, and some sections also relate to Scotland. Reporting requirements The Act introduces a requirement on the Government to report on a number of different topics: An annual report on steps taken by the Government to reduce emissions of greenhouse gases [Section 2(a)]; An annual report on the level of emissions of greenhouse gases in the UK [Section 2(b)]; Include in the annual report from section 1 of the Sustainable Energy Act (the Annual Report on Implementation of the Energy White Paper), whats been done to implement the Microgeneration Strategy [Section 6]; Also include in the same report information on progress made towards achieving the target (in the Housing Act 2004) for the energy efficiency of residential accommodation in England, emissions of CO2 in England and the number of households where people live in fuel poverty [Section 12]; Also in the same report include information on actions taken to promote community energy projects and the use of heat produced from renewable sources [Section 22]; By August 2007, produce an energy measures report documenting steps that local authorities (in England and Wales) should use to improve energy efficiency, increase microgeneration, reduce greenhouse gas emissions or reduce fuel poverty [Section 3]; Also by August 2007, produce a report into how dynamic demand technologies can reduce greenhouse gas emissions in England, Wales and Scotland, and whether or not their use should be promoted [Section 18]. Microgeneration Targets The Act will give power to the Government to designate microgeneration targets for England and Wales and Scotland between November 2008 and March 2009, if on 1 November 2008 it decides its necessary. If a target is set, then the Government must take action to ensure it is met, and it must report on what actions have been taken. If the Government decides not to set a target, then it must explain why it has reached this decision. Sale of Electricity from Microgeneration From 21 August 2007 until 21 August 2009, the Government has the power, if it thinks it necessary and following a suitable consultation, to take steps to increase the amount of electricity generated by microgeneration. These steps include modifying the conditions of a distribution or supply licence in England, Wales and Scotland, or modifying the standard conditions of distribution or supply licences. Households with microgeneration equipment often produce more electricity than they consume, and the intention is to allow the market time (1 year from the Act coming into force) to develop a scheme whereby those customers can sell their excess electricity back to their electricity supplier. Ofgem The Act commits the energy market regulator, Ofgem, to consider the effects of microgeneration on the market in England, Wales and Scotland. Permitted Development Orders The Act commits the Government to carrying out a review of Permitted Development Orders to facilitate the installation of microgeneration equipment on houses in England. Following the review, it must report to Parliament on its findings on and take the action that the report recommends. The intention is to look at whether or not certain type of microgenerating equipment, such as micro wind turbines, should be considered as satellite dishes are now under the PDOs e.g. no planning permission is required on most houses to install a satellite dish, its automatically permitted. So should householders in England be similarly allowed to install micro wind turbines without planning permission? Building Regulations The Act also allows the Government to make building regulations covering microgeneration in England and Wales. It also extends the time limit (to six months) within which local authorities in England and Wales may bring prosecutions for breaches of those parts of the Building Regulations governing the conservation of fuel and power. The Government must also present a report (by February 2007) to Parliament on the steps taken (and proposed) to ensure greater compliance in England and Wales with the relevant building regulations. Promoting Reducing Carbon Emissions The Act changes the legislation that provides the framework for the Energy Efficiency Commitment (EEC) to enable future phases of EEC to be focused on carbon reductions, if this is desirable. Rather than imposing obligations for energy suppliers and distributors to achieve energy efficiency targets, the changes will enable the Government to achieve carbon emissions reductions targets in England, Wales and Scotland. Communities and Energy The Government must promote community energy projects (<20Mwatts electrical, <100Mwatts thermal) in England and Wales. It must also promote the use of heat produced from renewable sources. The Act also explicitly gives Parish Councils in England and Wales the power to promote local energy saving measures, energy efficiency and microgeneration. Renewables Obligation The Act allows the Government to change the Renewables Obligation Order (ROO) to allow agents in England, Wales and Scotland to act on behalf of generators. This will reduce the administrative burden placed on generators through having to complete the accreditation process and also submit data for claiming Renewable Obligation Certificates (ROCs). It also allows the ROO to be amended to enable an agent to amalgamate the output of two or more generating stations for the purposes of claiming ROCs. This will reduce the administrative burden on generators and allow generators who produce small amounts of electricity easier access to the benefits of ROCs by combining their output with that of other generators. Finally it also allows the ROO to be amended to allow the removal of the requirement for a sell and buyback agreement for smaller generators. This will simplify administrative arrangements for generators and suppliers as well as allowing generators to claim ROCs for electricity they consume themselves. Adjustment of Transmission Charges for Electricity Section 185 of the Energy Act gives the Secretary of State the power to adjust transmission charges for renewable generation in an area of GB with significant potential for renewable development, where that development would otherwise be deterred by the high level of transmission charges that would apply This Act alters the existing Energy Act legislation to extend the potential life of any scheme from 10 to 20 years, which is necessary to allow the schemes time to become cost effective; it also clarifies that a scheme may apply to separate islands.
